Terms of Service

Last updated: January 1, 2025

1. Acceptance of Terms

By accessing or using the Zoxrim platform (the "Service"), provided by FloodHacking LLC ("Zoxrim," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

If you do not agree with any part of these Terms, you must not access or use the Service. We reserve the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

2. Description of Services

Zoxrim provides a cybersecurity intelligence platform that includes:

  • Security scanning: Real-time analysis of URLs, domains, IP addresses, files, and email messages against threat intelligence databases and AI-powered detection models.
  • Email monitoring: Detection of phishing attempts, business email compromise, and malicious attachments or links within email content.
  • Threat intelligence: Aggregated intelligence from 15+ threat feeds including dark web monitoring, reputation databases, and community-reported indicators of compromise.
  • API access: Programmatic access to our scanning and intelligence endpoints for integration into your own applications, subject to the rate limits of your subscription tier.

We may modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will endeavor to provide advance notice of material changes that affect existing functionality.

3. Account Responsibilities

To use certain features of the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration and keep it up to date.
  • Choose a strong, unique password and keep it confidential. We recommend using a password manager.
  • Notify us immediately at [email protected] if you suspect unauthorized access to your account.
  • Accept responsibility for all activity that occurs under your account, whether or not you authorized it, until you notify us of a compromise and we take action.
  • Not share account credentials with other individuals. Team plans are available for multi-user access.

4. Prohibited Uses

You agree not to use the Service for any of the following purposes:

  • Submitting spam, unsolicited bulk messages, or harvesting email addresses for mass distribution.
  • Making automated bulk API requests that exceed your subscription's rate limits, or using technical means (proxies, VPNs, multiple accounts) to circumvent those limits.
  • Reverse engineering, decompiling, disassembling, or attempting to extract source code from the Service or its underlying infrastructure.
  • Using scan results or threat data to target, harass, stalk, or otherwise harm individuals or organizations, including using our Service to build attack tools or threat profiles of specific targets.
  • Violating any applicable local, national, or international law or regulation.
  • Impersonating another person or entity, or misrepresenting your affiliation with any person or entity.
  • Introducing malicious code, viruses, or other harmful material into the Service's infrastructure.

We reserve the right to investigate any suspected violation and take appropriate action, including immediate account suspension, without prior notice.

5. Intellectual Property

All intellectual property in the Service — including the Zoxrim and FloodHacking names and logos, the platform's software, algorithms, threat intelligence models, design elements, and documentation — is owned by FloodHacking LLC or its licensors and is protected by copyright, trademark, patent, and other intellectual property laws. Nothing in these Terms grants you any ownership rights in the Service.

You retain full ownership of all data you submit to the Service ("User Data"). By submitting User Data, you grant us a limited, non-exclusive, royalty-free license to process that data solely for the purpose of delivering the Service to you. We do not claim ownership over your User Data and will not use it for any purpose beyond those described in our Privacy Policy.

6. Payment Terms

Paid subscriptions are billed through Stripe, Inc. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel:

  • Auto-renewal: Subscriptions renew automatically at the end of each billing period (monthly or annual). You will receive a reminder email before each annual renewal.
  • Annual plan refunds: If you cancel an annual subscription within 7 days of purchase or renewal, you are entitled to a full refund. After 7 days, no refund is available but access continues until the end of the billing period.
  • Monthly plan refunds: Monthly subscriptions are non-refundable after 48 hours from the initial purchase or renewal date.
  • Price changes: We will notify you at least 30 days before any price increase takes effect. You may cancel before the new price applies.
  • Failed payments: If a payment fails, we will attempt to charge your card up to three times over 7 days before downgrading your account to the Free tier.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will catch 100% of threats or that our threat intelligence is always current, complete, or accurate. Cybersecurity is an arms race, and novel threats may not be detected immediately. Zoxrim is a powerful additional layer of protection, not a replacement for a comprehensive security program.

We do not warrant that the Service will be uninterrupted, error-free, or free from viruses or other harmful components.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FLOODHACKING LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO ZOXRIM IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

9. Indemnification

You agree to defend, indemnify, and hold harmless FloodHacking LLC and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property or privacy rights; or (d) any claim that your User Data caused damage to a third party.

10. Termination

We may suspend or permanently terminate your access to the Service at our sole discretion, without prior notice or liability, for any reason — including if we believe you have violated these Terms. Upon termination, your right to use the Service will immediately cease.

You may cancel your account at any time from Settings → Account → Delete Account. Upon cancellation, we will retain your data for 30 days to allow for reactivation, after which it will be permanently deleted as described in our Privacy Policy.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Delaware. If you are a consumer in a jurisdiction that requires disputes to be resolved locally, applicable local law may apply to the extent required.
